GENERAL TERMS AND CONDITIONS

These General Conditions of Sale (hereinafter, General Conditions) have as their object the regulation of the purchase of Products, carried out remotely, through the network
telematics, from the Website www.naicositaly / beauty (hereinafter, the Website).
The owner of the site is GOLDEN CHIMIGAL srl.

Acceptance of the general conditions of sale
All purchases of Products made through the Site (hereinafter, the Contracts
of Purchase) by the users who access it (hereinafter, the Customers) are governed by these General Conditions as well as by the Italian Consumer Code (Legislative Decree no. 206/2005), section II Distance contracts (art. 50 - 67) and the Italian rules on electronic commerce (Legislative Decree 70/2003).
With the conclusion of the Purchase Contracts, according to the procedure, the Customer accepts and undertakes to observe these General Conditions.
The customer, therefore, is required to read carefully, before making any
purchase transaction, these General Conditions that GOLDEN CHIMIGAL srl
also makes available to him in order to allow him to reproduce and
memorization in compliance with the provisions of art. 12, paragraph 3 of the Legislative Decree
70/2003.
GOLDEN CHIMIGAL srl may modify, at any time and without notice, the content of the General Conditions. For every single Purchase Agreement yes
the General Conditions published on the Site at the time of sending will apply
the purchase order itself by the Customer.
Products www.naicositaly.com (hereinafter the "Site") is an online sales site of
cosmetic products for sport with the exclusive NAICOS brand (hereinafter, "Products"). All the Products offered are illustrated in detail on the Site, within the respective sections, divided by Product categories.
The visual representation of the Products on the Site, where available, is indicative and normally corresponds to the photographic image of the Products themselves and has the sole purpose of presenting them for sale, without any guarantee or commitment, by GOLDEN CHIMIGAL srl, about the '' exact correspondence of the image depicted on the Site with the actual Product; and this, with particular regard to its real dimensions and / or the chromatic aspects of the Products and / or packaging.
In case of difference between the image and the written product sheet, the description of the product sheet always prevails.

Purchase procedure

The Customer can purchase the Products present with descriptions and illustrations on the Site
within the respective sections by product category, as described in
related information sheets contained on the Site, respecting the technical procedures of
access illustrated therein.
To purchase the Products, the Customer must complete and send the order form in
electronic format available on the site, following the instructions therein. The orders
purchase orders must be filled out exactly in their entirety.
The Customer must enter the selected Products in the appropriate "Cart" and, after having chosen
the delivery method and the contribution for delivery costs has been examined and accepted,
can proceed with the purchase.
If the customer needs to change only before sending the order
purchase or to modify some data contained therein must follow the appropriate procedure

Conclusion of the contract

Each Purchase Agreement stipulated between GOLDEN CHIMIGAL srl and the Customer must

of the order to the e-mail address of the Customer. This confirmation message
will indicate an "Order Number", to be used in any subsequent communication with
GOLDEN CHIMIGAL srl. The message will re-propose, in addition to the mandatory information
by law, all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections. Possible increase in costs caused by errors in the data not reported promptly, will be the sole responsibility of the Customer.
It is possible that occasional unavailability of the Products offered may occur, in this case, if the Products chosen by the Customer are not, in whole or in part, available, the order will be sent with the products available after sending communication to the Customer regarding the products. not available.
GOLDEN CHIMIGAL srl has the right to accept or not, at its discretion,
the order sent by the Customer, without the latter being able to make claims or rights of any kind, for any reason, including compensation, in the event of non-acceptance of the order.
In particular GOLDEN CHIMIGAL srl reserves the right not to accept proposals of
purchase and cancel orders that do not give sufficient guarantees of solvency or
if - also following a comparison with the circuit that manages credit card payments - anomalies are found in the transactions and payment methods used by the Customer.
The Customer can check the content of the concluded purchase contracts at any time by contacting NAICOS Customer Service. These data will be available for a period of 12 months from the delivery of the Products.

Product prices

All Product prices are clearly indicated on the Site and are inclusive of 22% VAT. Delivery costs are adequately highlighted at the time of the order. The cost of each shipment may vary according to the method of delivery and payment as well as the destination and the total amount of the order.

Billing and payment methods

GOLDEN CHIMIGAL srl issues an invoice / tax receipt for the Products purchased, in
moment in which the Products are delivered to the courier for shipment, inserting the same in paper format inside the package. For the issuance of the invoice, the information provided by the Customer is valid. No data changes will be possible after the invoice has been issued.
As detailed below in the relative points, the payment of the purchased Products is made by credit card, PayPal, cash on delivery, bank transfer according to the methods specified below: Online credit cards

The accepted credit cards are: Visa, Visa Electron, Mastercard, VPay, Maestro,
American Express. All data is transferred in encoded form using SSL certificates and therefore cannot be intercepted by external parties. Furthermore, the data is entered directly on the Stripe.com website (Credit Card Payment Gateway), thus guaranteeing maximum security.

PayPal

PayPal, an eBay company, is a fast and secure payment system. One time
after completing the order and choosing the PayPal method as payment method, the buyer will be redirected to the PayPal Site, where he can access his account by entering his personal e-mail address and password. After registration, payments can be made via PayPal without having to re-enter the data, even for subsequent purchases. By choosing to pay with PayPal the amount is charged directly to the
credit card (Visa, Visa Electron, Mastercard, American Express) or prepaid
(PostePay) assigned. PayPal protects buyer's information as it does not
financial information is passed on. With every transaction made with this
method a confirmation email will be sent from PayPal.

Cash on delivery

The Customer can pay directly to the courier who will deliver the ordered Products. For
this method of payment only cash is accepted. The courier will not accept bank checks or cashier's checks and will not deliver the Products if it does not receive the exact amount indicated in the order. The courier is not authorized to give change.

Bank transfer

The Customer can pay for the Products ordered by bank transfer. For this mode of
payment the ordered products will be shipped only by bank transfer credited to the account
company current.

Delivery methods and costs
GOLDEN CHIMIGAL srl undertakes to deliver the goods without undue delay e
in any case no later than thirty days from the conclusion of the contract. The delivery of the
Products will be made by express courier, and the times will vary according to the destination. The terms indicated at the time of the purchase order are however indicative.
GOLDEN CHIMIGAL srl delivers by express courier throughout Italy and delivery will take place without an appointment.

We offer our customers the possibility to collect the order at our office:
GOLDEN CHIMIGAL srl located in Via Maddalena 170 / A 25075 NAVE (Brescia) from
Monday to Friday at the following times: 8.00 - 12.00 and 13.00 - 17.00.
No responsibility, in any capacity, can be charged to GOLDEN
CHIMIGAL srl by the Customer in case of delay in the order or delivery of the Products covered by the Purchase Contracts.
The ordered Products will be sent to the postal address specified by the Customer. Alla
delivery of the Products by GOLDEN CHIMIGAL srl to the courier in charge, an e-mail confirming the shipment will be sent to the Customer.
Deliveries will be made by courier chosen by us, from Monday to Friday, during normal office hours, excluding national holidays. Delivery is considered completed when the Product is made available to the Customer at the address specified in the order form. In case of non-delivery due to the absence of the recipient at the specified address, the courier will send an email notice and will attempt a new delivery according to the methods established by them. In the event that the Customer Service fails to contact the Customer or in the event of further impossibility of delivery due to the absence of the recipient, the Products covered by the order will be returned to GOLDEN CHIMIGAL srl. After 30 (thirty) days from the date on which the Products covered by the order have been returned to GOLDEN CHIMIGAL srl due to the impossibility of carrying out the delivery, the contract will be considered terminated and the purchase order
canceled pursuant to art. 1456 cc; GOLDEN CHIMIGAL srl will proceed with the refund
of the sum paid by the Customer, net of the costs of returning the Products and the cost of keeping them at the branch of the courier appointed for delivery.
The termination of the contract and the amount of the refund will be communicated via e-mail.
The refund amount will be credited to the payment method used by the Customer for the purchase. In the event that, before the expiration of the thirty days, the Customer requests to receive the purchased Products again, GOLDEN CHIMIGAL srl will proceed with the new delivery after charging, in addition to the costs of the same, the costs of returning the Products to GOLDEN CHIMIGAL srl and custody fees.
Upon delivery of the Products by the courier appointed by GOLDEN CHIMIGAL srl, the Customer is required to scrupulously check:
That the anti-burglary tape is intact and the packaging is not damaged, wet or, in any case, altered, even in the closing materials.
That the number of pieces delivered corresponds to what is indicated in the document
transport.
Any damage to the anti-burglary tape, the packaging and the Products or failure
correspondence of the number of pieces / packages or indications must be
immediately contested by the Customer to the courier who makes the delivery, adding the words "Goods control reserve" on the accompanying document and immediately confirmed by email or telephone to GOLDEN CHIMIGAL srl through Customer Service specifying the order for which they occurred such misunderstandings.

Cases of force majeure, unavailability of means of transport, as well as unforeseeable events
or unavoidable that cause a delay in deliveries or make deliveries difficult or impossible or cause a significant increase in the delivery cost charged to GOLDEN CHIMIGAL srl, will give it the right to split, postpone or cancel, in whole or in part, the delivery envisaged or to terminate the Purchase Agreement. In such
hypothesis will be the responsibility of GOLDEN CHIMIGAL srl to provide prompt and adequate
communication of their decisions to the e-mail address indicated by the Customer and the latter will have the right to a refund of the price possibly already
paid, excluding any further claim, for any reason, against
GOLDEN CHIMIGAL srl.

Discount Coupons - Promotions

Any discount coupons or promotional codes can be entered at the time of
compilation of the purchase order by the Customer. The system will provide for
update the total amount of the order net of the value of the voucher.
The discount coupon can be combined with other commercial initiatives only in cases where it is expressly indicated.
Right and terms for the withdrawal exercise
The Customer is protected by Italian legislation regarding the right of withdrawal (DL
15/01/92 n. 50).
Pursuant to art. 52 of the Italian Consumer Code and subject to the exclusions referred to
to art. 59 of the same code (see in particular the hypothesis of purchase of goods
clearly personalized or the supply of sealed goods that do not lend themselves to being returned for hygienic reasons or related to health protection and have been opened after delivery), the buyer can, within the period of 14 (fourteen) days from acquisition physical possession of the package containing the ordered goods or, in the case of the purchase of multiple goods ordered by the Customer in a single order and delivered separately, from the acquisition of physical possession of the last purchased good, withdraw from the purchase contract without penalty and without any reason.
The Customer has the right to withdraw from the contract stipulated in terms of these General Conditions, without any penalty and without specifying the reason, within fourteen working days starting from the day of receipt of the Product, pursuant to art. 64 and ss. of the Consumer Code (Legislative Decree 22.07.2005 n. 206).
The withdrawal period expires after 14 days from the day on which the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the last batch or piece.

Method of exercising the right of withdrawal

To exercise the right of withdrawal, the Customer is required to notify GOLDEN
CHIMIGAL srl its resolution will through an explicit declaration

Consequences from the exercise of the right of withdrawal

The Customer, exercising the right of withdrawal pursuant to this article, within the terms and in the manner described in the aforementioned article for the return of products.

Exclusions from the right of withdrawal

In compliance with the provisions of current regulations and in compliance with what
stipulated between the Parties, the right of withdrawal is excluded in the case of orders:
relating to assets that are likely to deteriorate or expire rapidly;
relating to the supply of sealed goods that are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery; relating to goods which, after delivery, are, by their nature, inseparably mixed with other goods.
Non-conformity of products and defective products
The Products offered on the Site comply with national and community legislation. The
images and colors of the Products published on the Site may differ from the real ones due to the local settings of the systems and / or tools used for their display.
In case of lack of conformity of the purchased Products with respect to the description published on the Site and in the case of a faulty or defective Product, the Customer has the right to immediate reimbursement of the non-compliant goods, after sending photographs through the form in the Customer Service section. that highlight the damage or non-conformity of the Product.

In any case, the provisions on the legal guarantee of conformity of goods, provided for by the Italian Consumer Code (Legislative Decree 206/2005, Part IV, Articles 102-135) are reserved.
